New Virginia Law Makes It Easier to Switch Medicare Supplement Plans – Thanks to the Birthday Rule! Exciting news for Virginia Medicare beneficiaries. A brand-new law was just signed that gives you more freedom and flexibility with your Medicare Supplement (Medigap) plan.

What Happened?

  • Effective Date: July 1, 2025

This new law introduces something called the “Birthday Rule,” and it’s going to make it much easier for you to shop around for a better Medicare Supplement plan—without worrying about your health history.


What Is the Birthday Rule?

Starting July 1, 2025, if you have a Medicare Supplement (Medigap) policy in Virginia, you’ll have a 60-day window each year starting on your birthday to switch to a different Medigap plan with equal or lesser benefits—no health questions asked.

That means:

  • No medical underwriting
  • No denial for preexisting conditions
  • No rate hikes based on health
