CMS is Cracking Down on Misleading Medicare Advantage Ads: What You Need to Know

Starting September 30, 2023, there are going to be some new regulations in place for Medicare Advantage (MA) advertising.

Celebrities like Joe Namath, William Shatner, or Jimmy Walker will need to disclose which insurance plan they are endorsing, and they can’t misuse the Medicare logo or card to make it seem like they represent the federal government.

This is all part of a larger effort by the Centers for Medicare & Medicaid Services (CMS) to crack down on misleading marketing schemes by health insurance companies.

For example ads for Medicare Advantage will need to clearly specify the name of the plan they are promoting, and the use of the name Medicare and images of the Medicare card will be limited in marketing materials to prevent confusion about who is actually providing the coverage.

The new regulations also require brokers, insurance agents, and others who market MA plans to fully explain the coverage they are selling and to make sure consumers understand what they are getting into. It’s all about transparency and making sure people have the information they need to make informed decisions about their healthcare coverage.
